Subiectul privind scoaterea posturilor militare de pacificatori ar trebui să fie prioritar pe agenda negocierilor în formatul 5+2. De această părere este preşedintele Asociaţiei Promo-LEX, Ion Manole. Expertul în domeniul drepturilor omului a declarat că incidentul de la postul trilateral al forţelor de pacificare nr. 9, unde un pacificator a rănit mortal un localnic, ar trebui să oblige autorităţile constituţionale să ajungă la anumite rezultate, transmite Info-Prim Neo.
Preşedintele Promo-LEX spune că este straniu că acest caz a avut loc tocmai în momentul în care la Tiraspol a avut loc schimbarea de regim. „Şevciuk (noul lider, n.r.) a declarat că va face mai uşoară traversarea acestor posturi ilegale. Evident, există cercuri şi la Tiraspol, şi la Moscova, cărora un astfel de gest nu le-ar conveni”, a menţionat juristul.
Potrivit lui Ion Manole, de nenumărate ori s-a menţionat despre faptul că aceste posturi nu au niciun rol, niciun scop şi nicio importanţă. „Dacă forţele pacificatoare au rolul de a preveni un nou conflict sau o nouă confruntare militară între malul stâng şi drept, aşa cum se pretinde, atunci nu înţeleg de ce aceste posturi sunt amplasate în interiorul teritoriului controlat de către autorităţile centrale? În această situaţie nu este clar pe cine şi de cine apără aceste posturi. Pe Pârâta de Chişinău sau pe Chişinău de Pârâta”, a menţionat juristul.
Expertul a mai spus că protestele localnicilor ar putea avea un anumit efect, dar proteste au mai avut loc şi la postul de la Pohrebea şi acestea nu s-au soldat cu nimic. „Oamenii s-au revoltat, dar dacă nu au primit atenţia cuvenită din partea autorităţilor, din partea comunităţii internaţionale, au cedat”, a menţionat Ion Manole.
Asociaţia Promo-LEX va oferi asistenţă juridică familiei tânărului decedat. Potrivit lui Ion Manole, este nevoie de o examinare atentă a circumstanţelor pentru a vedea ce se poate face. „Persoana care a împuşcat este vinovată de moartea tânărului. Acum urmează să vedem care este comportamentul autorităţilor, care este procedura, care este situaţia şi statutul acestor pacificatori pentru a vedea care este calea cea mai corectă pentru a apăra drepturile localnicilor. Este un caz care nu se întâmplă în fiecare zi. În 20 de ani nu am avut aşa ceva. Este destul de complicat, dar sunt sigur că există posibilităţi la nivel naţional de a apăra drepturile acestei familii”, a menţionat juristul.
Ion Manole a mai spus că acum este importat să fie analizate acţiunile şefului schimbului de post nr.9. „Eu personal am fost acolo şi am văzut urmele gloanţelor trase în acest automobil. Conform observaţiilor, putem spune foarte clar că persoana a fost împuşcată în spate, când nu prezinta niciun pericol pentru cel care a tras şi nu a atentat în niciun mod la viaţa şi sănătatea celor care stau la aceste posturi. Este evident că nu contează în ce stare era tânărul în care s-a tras. Contează incompetenţa sau reavoinţa ofiţerului rus care a împuşcat în spate un om nevinovat, un om neînarmat”, a spus juristul.
Vadim Pisari a murit la spital, la scurt timp după ce a fost rănit de către şeful schimbului de post nr.9, pe segmentul podului de peste râul Nistru. Tragedia s-a produs în dimineaţa zilei de 1 ianuarie. Potrivit Procuraturii Dubăsari, victima se deplasa cu un automobil din satul Pârâta spre localitatea Vadul lui Vodă. În viteză a dezbătut bara de protecţie a postului nr. 9 şi a plecat de la faţa locului fără a reacţiona la semnalul santinelelor de post de a opri. Peste puţin timp, făcând cale întoarsă pe acelaşi segment, şoferul a fost semnalat din nou să oprească, dar tot nu a reacţionat. Şeful schimbului de post a efectuat câteva trageri din arma din dotare AKC 74. Un glonţ a străpuns uşa pasagerului din stânga şi a pătruns prin scaunul şoferului, rănindu-l grav în regiunea spatelui.
În urma conflictului armat din primăvara-vara anului 1992 şi a semnării de către Rusia şi Moldova a Acordului cu privire la principiile reglementarii paşnice a conflictului (21 iulie 1992), de-a lungul râului Nistru a fost instituită Zona de Securitate, din care trebuiau să fie retrase forţele militare şi militarizate, obiectiv nerealizat însă de partea transnistreană. La decizia Comisiei Unificate de Control, instituită pentru realizarea obiectivelor din acord, în Zona de Securitate au fost introduse forţe mixte de menţinere a păcii. Moldova pledează pentru înlocuirea trupelor militare de menţinere a păcii cu forţe civile cu mandat internaţional.

According to Ion Manole, it was repeatedly said that these posts have no role, goal or importance. “If the peacekeeping forces play the role of preventing a new conflict or a new military confrontation between the right and the left banks of the Nistru, as it is claimed, why are these posts situated on the territory controlled by the central authorities? It is thus not clear who these posts protect and from whom – Pirita from Chisinau or Chisinau from Pirita,” stated the jurist.
The expert also said that the protests staged by the locals may have a certain effect, but the protests mounted at the post in Pohrebea produced no results. “The people expressed their dissatisfaction, but gave up because the authorities did not support them,” said Ion Manole.
Promo-LEX will provide legal assistance to the family of the killed young man. Ion Manole said the circumstances must be examined thoroughly so as to see what can be done. “The person who shot is to blame for the young man’s death. We will see what the authorities will do and what the status of these peacekeepers is so that we are able to better protect the rights of the locals. It is a rare case. Nothing like that happened in 20 years. The situation is difficult, but I’m sure there are possibilities at national level to defend the rights of this family,” said the jurist.
Ion Manole also said that it is now important to analyze the steps taken by the chief of peacekeeping post No.9. “I was there and saw the tracks of the bullets shot at the car. It is evident that the man was shot in the back, when he did not pose a threat to the person who shot and to the life and health of those serving at the post. The state of the young man does not count. It is the ill will and incompetence of the Russian officer who shot an innocent and unarmed man that count,” said the jurist.
A Russian peacekeeper of the trilateral peacekeeping post No. 9 located on the bridge near Vadul lui Voda shot fatally a local who was driving a car in the morning of January 1. Vadim Pisari from Pirita died in the hospital shortly after he was shot.
As a result of the armed conflict of the spring-summer of 1992, Moldova and Russia signed an agreement concerning the principles of peacefully settling the conflict. One of the provisions envisioned the institution of a security zone with joint peacekeeping forces. Moldova pleads for replacing these posts with internationally-mandated civil forces.

Председатель ассоциации Preşedintele Promo-LEX считает странным, что подобный случай произошел именно в тот момент, когда в Тирасполе произошла смена режима. „Шевчук (новый лидер тираспольской администрации, наше примечание) заявил, что облегчит проезд через эти незаконные посты. Очевидно, существуют определенные круги и в Тирасполе, и в Москве, которых подобная мера может не устраивать”, – подчеркнул юрист.
По словам Иона Маноле, уже множество раз отмечалось, что эти посты не играют никакой роли, не имеют никакой цели и никакого значения. „Если миротворческие силы играют роль в предупреждении нового конфликта или нового военного противостояния между левым и правым берегами, как это утверждается, тогда я не понимаю, почему эти посты располагаются на территории, контролируемой центральными властями? В этой ситуации не ясно, кого и от кого защищают эти посты. Село Пырыта от Кишинэу или Кишинэу от села Пырыта?” – сказал председатель ассоциации Promo-LEX.
Эксперт добавил, что протесты местных жителей могли бы дать какой-то эффект, но протесты проводились и на посту в Похребя. Тогда они закончились ничем. „Люди возмутились, но так как они не получили должного внимания от властей, от международного сообщества, отступили”, – констатировал Ион Маноле.
Ассоциация Promo-LEX окажет юридическую помощь семье скончавшегося молодого человека. По словам Иона Маноле, необходимо внимательно изучить обстоятельства, чтобы определить, что можно сделать. „Стрелявший виновен в смерти молодого человека. Сейчас мы посмотрим на поведение властей, посмотрим на процедуру, на ситуацию и статус этих миротворцев, чтобы понять, какой более правильный путь для защиты прав местных жителей. Такое случается не каждый день. За 20 лет не было ничего подобного. Все это достаточно сложно, но я уверен, что на национальном уровне есть возможности для защиты прав этой семьи”, – подчеркнул юрист.
Ион Маноле добавил, что сейчас важно проанализировать действия начальника смены с поста №9. „Лично я был там и видел следы пуль, выпущенных по этому автомобилю. Согласно наблюдениям, можем абсолютно четко сказать, что человеку стреляли в спину, когда он не представлял никакой угрозы для стрелявшего и никак не посягал на жизнь и здоровье тех, кто стоит на этих постах. Очевидно, что не важно, в каком состоянии был молодой человек, в которого стреляли. Важна некомпетентность и злонамеренность российского офицера, который стрелял в спину невиновному человеку, безоружному человеку”, – заключил председатель ассоциации Promo-LEX.
Вадим Писарь скончался в больнице в скором времени после того, как был ранен начальником смены с поста №9 на мосту через Днестр. Трагедия произошла утром 1 января. По данным прокуратуры района Дубэсарь, молодой человек ехал на автомобиле из села Пырыта в город Вадул луй Водэ. Двигаясь на полной скорости, автомобиль снес шлагбаум на посте №9, а водитель не реагировал на сигналы караульных остановиться. Через некоторое время, возвращаясь той же дорогой, водитель вновь получил сигнал остановиться, но снова не отреагировал, продолжая движение. Начальник смены произвел несколько выстрелов из автомата АКС-74. Одна из пуль пробила левую пассажирскую дверь и ранила водителя в район спины.
В результате вооруженного конфликта, произошедшего весной-летом 1992 года, и подписания Россией и Молдовой Соглашения о принципах мирного урегулирования конфликта (21 июля 1992 года) вдоль реки Днестр была учреждена Зона безопасности, из которой должны были быть выведены военные и военизированные силы, однако этот принцип приднестровская сторона не выполнила. Согласно решению Объединенной контрольной комиссии, учрежденной для реализации задач соглашения, в Зону безопасности были введены смешанные миротворческие силы. Республика Молдова выступает за замену миротворческих войск гражданскими силами с международным мандатом.
